1. Introduction

These Pricing and Payment Terms (“Terms”) govern the use of paid services offered through the SubbyWork.com website operated by SUBBYWORK LIMITED (“SubbyWork”, “we”, “us”, or “our”). By making use of paid services or accepting a commercial invoice through SubbyWork.com

These terms apply to all paid services offered by SubbyWork.com to commercial users, including contractors posting jobs or accessing subcontractor details. These services are not sold via consumer subscription but are invoiced monthly based on usage. SubbyWork.com paid services are intended strictly for business use by legally registered entities or sole traders acting in a commercial capacity. Consumer use is expressly excluded.

SubbyWork.com offers paid plans for main contractors to post job listings, access subcontractor profiles, and utilize additional recruitment tools. The following pricing models may be available:

Detailed pricing for each plan is made available on our Pricing page, discretionary to registered clients. All fees quoted are exclusive of applicable VAT or taxes unless otherwise stated.

Use of the platform is subject to a fair use policy. We reserve the right to monitor and restrict access where excessive or abusive usage is detected.

4. Billing and Payment

All commercial users of SubbyWork.com will be invoiced directly by SUBBYWORK LIMITED on a monthly basis for the services used during the previous billing period. No payment is made through the website. By using our paid services, you acknowledge and agree to be bound by these Pricing and Payment Terms, which form a legally enforceable agreement between you and SUBBYWORK LIMITED.

Invoices are issued electronically to the billing contact and email address you provide at registration or onboarding. You agree to maintain up-to-date billing details and to inform us promptly of any changes. Unless otherwise agreed in writing, all invoices must be paid in full within thirty (30) calendar days of the invoice date via bank transfer to the account specified on the invoice.

Failure to pay an invoice by the due date may, at our sole discretion, result in any or all of the following:

We reserve the right to request payment in advance for any future services in cases of repeated late payment or suspected misuse.

By continuing to access or use paid services on SubbyWork.com, you confirm your organization’s agreement to pay all applicable charges as invoiced, regardless of whether a formal purchase order or procurement agreement has been issued. Use of services constitutes acceptance of the commercial terms presented.

You acknowledge that internal procurement delays or payment approval processes within your organization do not constitute a valid reason for non-payment or delayed payment. It is your sole responsibility to ensure timely settlement of invoices.

5. Invoicing and Tax

All pricing is quoted exclusive of VAT, unless otherwise stated. VAT and other applicable taxes will be charged in accordance with Irish tax legislation or any applicable cross-border tax rules in force at the time of invoicing.

You are responsible for providing accurate and complete billing information, including your registered company name, billing address, VAT identification number (if applicable), and email address for invoice delivery. You warrant that the details provided are true and accurate, and agree to update us in a timely manner if any changes occur.

Invoices will include a clear breakdown of services provided, applicable taxes, payment due date, and our banking information. You agree to accept invoices in electronic format unless otherwise agreed.

In cases of dispute regarding invoiced amounts, you must notify us in writing within five (5) calendar days of receipt of the invoice. Disputing part of an invoice does not relieve you from the obligation to pay any undisputed amounts by the due date.

All invoices are issued in Euro (EUR) or Pound Sterling (GBP). If you remit payment in a different currency, you are responsible for ensuring that the full invoiced amount is received in EUR or GBP, net of any currency conversion fees, bank charges, or intermediary transaction costs.

You agree that SUBBYWORK LIMITED shall not be held liable for any penalties, missed filings, or tax obligations resulting from inaccurate billing or company information provided by you.

6. Refund Policy

All fees paid to SUBBYWORK LIMITED for access to SubbyWork.com services are non-refundable, except where required by applicable law. This includes, without limitation, fees paid for job postings, subscriptions, or bundled access packages.

As services are invoiced post-use and delivered digitally, you acknowledge and agree that the right of withdrawal under consumer protection laws (including the EU Consumer Rights Directive) does not apply to business-to-business transactions of this nature.

Refunds may be issued solely at our discretion in the following exceptional cases:

Any request for refund must be submitted in writing to billing@subbywork.com within ten (10) calendar days of the invoice date. Refunds, if approved, will be processed within thirty (30) days of approval.

Non-use of the service, failure to log in, or failure to post job listings during the billing cycle does not constitute a valid basis for a refund or waiver of fees.

7. Cancellation and Termination

You may cancel your use of SubbyWork.com paid services at any time by notifying us in writing at billing@subbywork.com. Cancellation will take effect at the end of the current monthly billing period unless otherwise agreed in writing.

Cancellation does not relieve you of the obligation to pay any outstanding invoices. Access to premium features will remain active until the end of the paid period, after which your account may revert to a limited-access version or be closed.

SubbyWork reserves the right to suspend or terminate any paid service, user account, or agreement immediately and without liability if:

SUBBYWORK LIMITED reserves the right to revise pricing, introduce new services, or modify these Pricing and Payment Terms at any time. You will be notified in writing of any price increase or material change to these Terms with at least fourteen (14) calendar days’ notice.

Continued use of paid services beyond the effective date of any changes will constitute your acceptance of the revised pricing or terms. If you do not agree, you may cancel your services prior to the change taking effect.

All information and features provided through SubbyWork.com are for informational and operational purposes only. You acknowledge and agree that no professional, legal, or financial advice is being provided, and no representation is made that the use of SubbyWork.com ensures any particular commercial outcome.

9. Limitation of Liability

To the maximum extent permitted by applicable law, SUBBYWORK LIMITED shall not be liable to you or any third party for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to lost profits, lost revenue, lost data, reputational harm, or business interruption, whether in contract, tort (including negligence), or otherwise, even if advised of the possibility of such damages.

In no event shall SUBBYWORK LIMITED’s aggregate liability arising out of or relating to the provision of paid services through SubbyWork.com exceed the total amount actually paid by you to SUBBYWORK LIMITED in the three (3) month period preceding the event giving rise to the claim.

You acknowledge and agree that SubbyWork.com is provided on an "as-is" and "as-available" basis, and that while we aim to ensure uninterrupted access, we do not warrant that the platform will be error-free, timely, secure, or available at all times.

10. Data Use and Retention

SUBBYWORK LIMITED does not store or process any payment card information or banking credentials through SubbyWork.com. However, in connection with invoicing and account management, we may collect and store certain business-related information including your company name, VAT number, billing address, and primary billing contact details.

This data is used solely for the purpose of generating, issuing, and managing invoices, tracking account activity, ensuring tax compliance, and facilitating customer communications related to payment or service delivery.

All such data is stored securely and retained only for as long as necessary to fulfill our contractual obligations and comply with applicable tax, accounting, and legal requirements. For more information on how we handle data, please refer to our Privacy Policy.

11. Entire Agreement

These Pricing & Payment Terms, together with our Terms and Conditions and Privacy Policy, constitute the entire agreement between you and SUBBYWORK LIMITED in relation to your use of SubbyWork.com paid services. They supersede all prior agreements, representations, or understandings, whether written or oral. Any deviation from these terms must be agreed to in writing and signed by an authorized representative of SUBBYWORK LIMITED. SUBBYWORK LIMITED reserves the right to request reasonable evidence of proper use of invoiced services for audit or compliance purposes, especially in the case of volume-based billing. Such requests will be limited in scope and frequency and must be addressed confidentially.

12. Force Majeure

SUBBYWORK LIMITED shall not be liable for any failure or delay in the performance of its obligations arising from or attributable to acts, events, omissions, or accidents beyond its reasonable control, including but not limited to strikes, lockouts, pandemics, natural disasters, war, terrorism, governmental action, failure of telecommunications networks, or failure of third-party hosting services.

13. No Partnership or Agency

Nothing in these Pricing & Payment Terms shall be construed as creating a joint venture, partnership, employment, or agency relationship between you and SUBBYWORK LIMITED. You agree that you do not have, and shall not represent that you have, any authority to bind us in any manner.

14. Assignment

You may not assign, transfer, or sublicense any of your rights or obligations under these Pricing & Payment Terms without the prior written consent of SUBBYWORK LIMITED. We may assign or transfer our rights and obligations without restriction.

16. Governing Law and Jurisdiction

These Pricing and Payment Terms shall be governed by and interpreted in accordance with the laws of Ireland. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Ireland.

17. No Waiver

No failure or delay by SUBBYWORK LIMITED in exercising any right or remedy under these Terms shall constitute a waiver of that or any other right or remedy. Any waiver must be in writing and signed by an authorized representative.

These Terms are provided in English and shall prevail in the event of any conflict or discrepancy with translated versions.
